Samui Beach Village Co Ltd

Samui Beach Village is a residential development on Nahai Beach near Hua Thanon on the south east coast of Koh Samui. The developer and management company is Siam Real Estate and Services Co Ltd. The development started in about 2004 and was completed in about 2010. The purchaser of each villa was required to enter into three agreements; a land sale and purchase agreement, a building agreement and a maintenance agreement. Each villa owner would then set up a Thai company for the land purchase and be bound by the terms of the building agreement and maintenance agreement thereafter. The developer was obliged to set up a limited company referred to as the "Common Area Company" which was in due course to become the legal and beneficial owner of the common area land on which the project road and common areas were erected thereon. The "Common Area Company" was named Samui Beach Village Co Ltd was set up and registered on 6th May 2005, just over a month after Samui Beach Village 10 Co Ltd was registered on 4th April 2005.

There are fourteen one and two storey luxury villas in Samui Beach Village. Baan Keaa is for sale and its position in the village is shown on the map above. Baan Keaa is also known as Villa 10, Samui Beach Village; hence the company name Samui Beach Village 10 Co Ltd. There is a 24-hour security guard on duty at the entrance to the common area road. The guards also patrol the village at night. This is part of the maintenance agreement for each of the villas. The common area in Samui Beach Village leads directly on to the beachfront known as Nahai Beach. The maximum distance from the furthest villa to the beachfront along the common area road and footpath is under 200 metres. The only traffic down the road is normally individual cars and taxis dropping people off or picking them up from their villa.

The footpath at the end of the common area provides the opportunity for photographers to snap many spectacular early morning sunrises like the one above.

Samui Beach Village is a residential development on Nahai beach near Hua Thanon on the south east coast of Koh Samui.

There is a private common area road, verge and path down to the beachfront which is held in a Thai registered common area company named Samui Beach Village Co Ltd which was registered on 6th May 2005.

Each villa owner has a chanote title held by a Thai registered limited company. Each of the fourteen villa owners on Samui Beach Village have a company which has a shareholding in the common area company Samui Beach Village Co Ltd.

For example the Thai registered company for Baan Keaa, villa 10 is Samui Beach Village 10 Co Ltd. It was the first Thai company to be registered beginning with "Samui Beach Village". It was registered on 4th April 2005.

Each villa owner has the rights of access and servitude across the full extent of the common area land.

All villa owners are party to a maintenance agreement which binds them to the terms of the management and maintenance fees and obligations. The agreement is administered by Siam Real Estate and Services Co Ltd. The maintenance agreement contains certain obligations on the maintenance company and certain obligations on the villa owners. In particular as follows: -

In article 4 (Security) of the maintenance agreement it states "Twenty Four (24) hour security and other measures shall be maintained in respect of the general security and safety of Samui Beach Village."

In article 8 (Noise) of the maintenance agreement it states "Any electrical appliance which can cause a high level of noise (e.g. television, radio, karaoke, electric tools, etc.) must only be used with due consideration for other residents. Excessive noise between 2300Hrs to 0800Hrs is strictly prohibited. In the event that the "Purchaser" wishes to hold the occasional party or festivities, the "Purchaser" shall notify all neighbours who may be affected by the noise."

In article 9 (Pets) of the maintenance agreement it states "The "Purchaser" may keep pets within the "Villa" but must ensure that the neighbours and the guests of the neighbours are not adversely affected in any way by such pets. The "Purchaser"'s pets must be kept on a leash when in the "Common Area" and it is the responsibility of the "Purchaser" to clean up after the "Purchaser"'s pets at all times. In cases where the keeping of pets disturbs the neighbours and the guests of the neighbours, the neighbours and the guests of the neighbours will be given priority and the "Purchaser" shall comply with any measures taken to so solve the problem."

All villa owners are permitted to rent out their villas. There are already several different management and rental agents operating on the village but the owners are permitted to use whosoever they wish providing they ensure that all occupants in the villas abide by the maintenance agreement rules.
